BruinCarpool Terms of Service

Please read these Terms of Service ("Terms") carefully before using the BruinCarpool website and application (the "Service") operated by BruinCarpool ("us," "we," or "our").

1. Acceptance of Terms

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

BruinCarpool provides a platform to connect users who are looking to offer or seek carpooling services ("Riders" and "Drivers"). We do not provide transportation services ourselves, nor are we a transportation carrier. Our role is solely to facilitate connections between users.

3. User Obligations and Safety

3.1. Responsibility

Users acknowledge and agree that they are solely responsible for all risks associated with their travel and interactions with other users, including but not limited to:

Verifying the identity of other users.
Assessing the safety and roadworthiness of any vehicle.
Complying with all applicable traffic laws, rules, and regulations.

3.2. Prohibited Conduct

Users agree not to:

Use the Service for any illegal or unauthorized purpose.
Discriminate against or harass any other person.
Use the Service to transport illegal substances, weapons, or hazardous materials.
Misrepresent their identity, driving history, or vehicle information.

4. Limitation of Liability

BruinCarpool shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service;
Any conduct or content of any third party on the Service (including other users);
Any disputes between users, including but not limited to, damages to property or personal injury that occur during a carpool trip.

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
